Uma grande parte das reformas regulamentares e dos projetos de investimento que tanto o governo de Espanha como os governos regionais iniciam, faz parte dos compromissos assumidos com a UE. Alguns est\u00e3o relacionados com o Plano de Recupera\u00e7\u00e3o, Transforma\u00e7\u00e3o e Resili\u00eancia (RTRP), e outros s\u00e3o transposi\u00e7\u00f5es de diretivas ou aplica\u00e7\u00f5es de Regulamentos. De facto, 51% dos projetos de lei aprovados em Espanha em 2021 prov\u00eam de uma iniciativa pol\u00edtica da UE<\/strong> (Gabinete de Liga\u00e7\u00e3o do Parlamento Europeu em Espanha, 2021). Dos 55 projetos de lei aprovados no Congresso, 28 quest\u00f5es regulamentadas eram origin\u00e1rias da UE.<\/p>\n Destas 28 leis, 11 eram transposi\u00e7\u00f5es de diretivas<\/strong> aprovadas pelo Parlamento Europeu e pelo Conselho em \u00e1reas como os res\u00edduos e os terrenos contaminados, a cadeia alimentar ou anti-branqueamento de capitais, entre outros. O resto veio de recomenda\u00e7\u00f5es, orienta\u00e7\u00f5es, programas ou iniciativas <\/strong>de diferentes institui\u00e7\u00f5es. Existem tamb\u00e9m alguns regulamentos<\/strong> que n\u00e3o precisam de ser aprovados pelas c\u00e2maras legislativas dos Estados-membros.<\/p>\n Existem ainda outros tipos de acordos pol\u00edticos<\/strong> celebrados entre os Chefes de Estado e os Governos dos Estados-membros, que t\u00eam um elevado impacto na vida quotidiana dos cidad\u00e3os e das empresas. Exemplos claros disto s\u00e3o a posi\u00e7\u00e3o relativa a crises como a da Ucr\u00e2nia ou a negocia\u00e7\u00e3o sobre taxonomia energ\u00e9tica, onde os argumentos t\u00e9cnicos se misturam com os argumentos pol\u00edticos. De facto, uma grande parte das quest\u00f5es legislativas e t\u00e9cnicas prov\u00e9m destes acordos pol\u00edticos.<\/p>\n Este Resumo de Pol\u00edticas, o primeiro de uma s\u00e9rie regular de notas pelos Assuntos Europeus da LLYC, centra-se nas prioridades legislativas atuais e futuras<\/strong> do legislador europeu, colocando-as no contexto pol\u00edtico atual<\/strong>. Trata-se de um roteiro que afetar\u00e1 direta e significativamente os cidad\u00e3os dos Estados-membros e as atividades econ\u00f3micas e produtivas das empresas. tecnocr\u00e1tico para passar a experienciar uma politiza\u00e7\u00e3o crescente nos \u00faltimos anos. Esta evolu\u00e7\u00e3o tem sido marcada por uma s\u00e9rie de crises, que for\u00e7aram a UE a dar respostas r\u00e1pidas e \u00e1geis que s\u00f3 os Governos e os seus Chefes de Estado podem assumir, afetando o debate a n\u00edvel nacional de muitas formas diferentes. Isto levou institui\u00e7\u00f5es governamentais<\/strong> tais como o Conselho da Uni\u00e3o Europeia e o Conselho Europeu a aumentar o seu impacto<\/strong>.<\/p>\n Embora a fun\u00e7\u00e3o do Conselho Europeu n\u00e3o seja legislativa, a institui\u00e7\u00e3o tornou-se fundamental na defini\u00e7\u00e3o de prioridades e do roteiro da UE. Por outras palavras: as a\u00e7\u00f5es legislativas e iniciativas espec\u00edficas seguem as orienta\u00e7\u00f5es gerais que os Estados-membros acordam em primeiro lugar.<\/p>\n Atualmente, a invas\u00e3o da Ucr\u00e2nia<\/strong> est\u00e1 no centro do debate pol\u00edtico. A forma como a UE responde a esta crise ir\u00e1, em grande medida, definir a dire\u00e7\u00e3o que as discuss\u00f5es mais relevantes seguir\u00e3o e, por conseguinte, tamb\u00e9m o futuro do projeto europeu. da UE, em 2016, a autonomia estrat\u00e9gica tornou-se um conceito cada vez mais destacado. Este documento concluiu que o soft power j\u00e1 n\u00e3o era suficiente e que a UE deve refor\u00e7ar as suas capacidades de seguran\u00e7a e defesa. Especificamente, a no\u00e7\u00e3o de autonomia estrat\u00e9gica exige a necessidade de a UE se tornar um ator global com capacidade para tomar decis\u00f5es de forma independente<\/strong>.<\/p>\n Muitos acontecimentos tiveram lugar no ano passado no \u00e2mbito deste debate, tais como o recuo do Afeganist\u00e3o ou o pacto AUKUS, que sublinhou, mais uma vez, a depend\u00eancia europeia dos EUA em quest\u00f5es de seguran\u00e7a e defesa, bem como a mudan\u00e7a das prioridades norte-americanas sobre a regi\u00e3o Indo-Pac\u00edfico. Estes acontecimentos levaram a Presidente Von der Leyen a apelar ao avan\u00e7o para a Uni\u00e3o Europeia de Defesa<\/strong> no seu discurso sobre o Estado da Uni\u00e3o, e o Presidente do Conselho Europeu declarou que 2022 seria \u201co ano da defesa europeia<\/em>“. A apresenta\u00e7\u00e3o da B\u00fassola Estrat\u00e9gica, que pretende ser o roteiro da UE sobre defesa e seguran\u00e7a ou a celebra\u00e7\u00e3o de uma Cimeira Europeia de Defesa durante a presid\u00eancia francesa do Conselho da UE s\u00e3o atividades previstas para este ano.<\/p>\n A UE tomou algumas medidas para avan\u00e7ar com a Pol\u00edtica Comum de Seguran\u00e7a e Defesa<\/strong>. No ano passado, a UE criou o Fundo Europeu de Defesa e o Mecanismo Europeu de Apoio \u00e0 Paz, que t\u00eam sido utilizados para financiar o fornecimento de materiais para as for\u00e7as armadas ucranianas.<\/p>\n Um dos principais obst\u00e1culos ao avan\u00e7o da autonomia estrat\u00e9gica tem sido o entendimento divergente da rela\u00e7\u00e3o da UE com a NATO e os EUA<\/strong>. Considerando que a Fran\u00e7a tem sido um dos principais defensores da autonomia estrat\u00e9gica europeia, os Estados-membros do Leste e do B\u00e1ltico t\u00eam estado mais relutantes em desistir de garantir a sua seguran\u00e7a sob a \u00e9gide da NATO.<\/p>\n O conflito na Ucr\u00e2nia<\/strong> tem tido um impacto em todas estas \u00e1reas. Resta saber como o conte\u00fado da B\u00fassola Estrat\u00e9gica ou a rela\u00e7\u00e3o da UE com a NATO e os EUA ser\u00e3o afetados por esta situa\u00e7\u00e3o. Ao contr\u00e1rio da diverg\u00eancia anterior, h\u00e1 vislumbres do realinhamento entre a NATO e os EUA e do ressurgimento da Alian\u00e7a Atl\u00e2ntica. A futura Declara\u00e7\u00e3o UE-NATO refletir\u00e1 tudo isto. Na verdade, Espanha acolher\u00e1 a Cimeira da NATO em Madrid no pr\u00f3ximo m\u00eas de junho.<\/p>\n Al\u00e9m disso, a autonomia estrat\u00e9gica tem uma clara componente econ\u00f3mica relacionada com o fornecimento de materiais b\u00e1sicos, conforme testemunhado durante a pandemia. Neste sentido, o futuro European Chips Act visa refor\u00e7ar a cadeia de valor dos microchips europeus, fundamental para o fabrico de autom\u00f3veis el\u00e9tricos.<\/p>\n A crise na Ucr\u00e2nia p\u00f4s igualmente em evid\u00eancia outras dimens\u00f5es para a autonomia estrat\u00e9gica, por exemplo, a depend\u00eancia energ\u00e9tica da UE<\/strong>. A 8 de mar\u00e7o, a Comiss\u00e3o apresentou um pacote de medidas para reduzir a depend\u00eancia do g\u00e1s russo at\u00e9 2030 e enfrentar a crise dos pre\u00e7os da energia. Entre outras propostas, os planos da Comiss\u00e3o de potenciar as energias renov\u00e1veis ou estabelecer n\u00edveis m\u00ednimos de armazenamento de g\u00e1s. Durante os \u00faltimos meses, Espanha tem sido um dos Estados-membros que t\u00eam defendido ativamente a necessidade de modificar o sistema marginalista do mercado europeu da eletricidade e desligar o pre\u00e7o do g\u00e1s do custo final da eletricidade. Ap\u00f3s uma dura batalha, o Conselho Europeu, nos dias 24 e 25 de mar\u00e7o, parece ter reconhecido este pedido: o n\u00edvel de interconectividade el\u00e9trica com o mercado \u00fanico da eletricidade ser\u00e1 tido em conta na decis\u00e3o sobre as medidas a tomar para enfrentar o aumento dos pre\u00e7os da energia, um convite claro de Espanha e Portugal para estabelecerem limites de pre\u00e7os nos seus mercados energ\u00e9ticos nacionais. \u00c9 agora necess\u00e1ria uma execu\u00e7\u00e3o final por parte da Comiss\u00e3o, que tamb\u00e9m dever\u00e1 apresentar, at\u00e9 maio, um plano para reduzir a depend\u00eancia do combust\u00edvel f\u00f3ssil russo.<\/p>\n Espanha decidiu posicionar-se explicitamente no debate sobre a autonomia estrat\u00e9gica, conforme provado pelo documento oficioso conjunto com os Pa\u00edses Baixos. O seu objetivo \u00e9 fornecer empresas e investidores com defini\u00e7\u00f5es precisas para que possam redirecionar os seus investimentos e esfor\u00e7os para a transi\u00e7\u00e3o verde.<\/p>\n Mesmo que isto pare\u00e7a mais uma quest\u00e3o t\u00e9cnica, tem uma clara implica\u00e7\u00e3o pol\u00edtica uma vez que colide frequentemente com interesses prim\u00e1rios dos Estados-membros. Desde que a Comiss\u00e3o apresentou a sua proposta de taxonomia, no in\u00edcio de 2022, iniciou-se um intenso debate<\/strong> entre posi\u00e7\u00f5es muitas vezes conflituosas.<\/p>\n Especificamente, a Comiss\u00e3o prop\u00f5e considerar a energia nuclear e o g\u00e1s<\/strong> como energias de transi\u00e7\u00e3o necess\u00e1rias para avan\u00e7ar para a neutralidade clim\u00e1tica. Esta classifica\u00e7\u00e3o seria positiva tanto para os interesses dos franceses (devido \u00e0 inclus\u00e3o da energia nuclear) como dos alem\u00e3es (gra\u00e7as \u00e0 considera\u00e7\u00e3o expl\u00edcita do g\u00e1s). No entanto, esta taxonomia tem sido fortemente criticada por outros Estados-membros. Por exemplo, a \u00c1ustria, a Dinamarca, a Su\u00e9cia e os Pa\u00edses Baixos enviaram uma carta \u00e0 Comiss\u00e3o solicitando a exclus\u00e3o dos gases f\u00f3sseis. A este respeito, Espanha tem mostrado publicamente a sua rejei\u00e7\u00e3o desta classifica\u00e7\u00e3o.<\/p>\n Esta controv\u00e9rsia agravou-se quando a Comiss\u00e3o decidiu adotar esta decis\u00e3o atrav\u00e9s de um ato delegado, o que levou o Luxemburgo a amea\u00e7ar tomar medidas legais. Em poucas palavras: as fasquias pol\u00edticas s\u00e3o elevadas.<\/p>\n A partir da apresenta\u00e7\u00e3o deste ato delegado a 2 de fevereiro, o Parlamento Europeu e o Conselho t\u00eam quatro meses para examinar o documento, com a possibilidade de pedir um prolongamento de dois meses. Suponhamos que ambos os co-legisladores n\u00e3o conseguem alcan\u00e7ar a maioria necess\u00e1ria para se oporem ao documento (algo que parece complicado, j\u00e1 que tem o apoio de dois grandes Estados-membros: Fran\u00e7a e Alemanha). Nesse caso, o ato delegado entraria em vigor a 1 de janeiro de 2023.<\/p>\n No entanto, este cen\u00e1rio pode ser substancialmente modificado pela invas\u00e3o da Ucr\u00e2nia.<\/strong> \u00c9 de A ado\u00e7\u00e3o deste instrumento foi inicialmente bloqueada pela Pol\u00f3nia e Hungria, que se opuseram a que o desembolso de fundos europeus fosse condicionado por estrita ades\u00e3o ao Estado de direito.<\/p>\n Como consequ\u00eancia, tanto a Pol\u00f3nia como a Hungria anunciaram que interporiam um recurso de anula\u00e7\u00e3o do Regulamento da Condicionalidade <\/strong>perante o Tribunal de Justi\u00e7a da Uni\u00e3o Europeia, atrasando, assim, o lan\u00e7amento do pr\u00f3prio mecanismo. A 16 de fevereiro, o Tribunal de Justi\u00e7a da UE proferiu uma senten\u00e7a a favor do mecanismo e rejeitou, portanto, os recursos.<\/p>\n Estes acontecimentos aumentaram a press\u00e3o sobre a Comiss\u00e3o Europeia para ativar efetivamente o mecanismo. O Parlamento Europeu criticou fortemente a Comiss\u00e3o por n\u00e3o o ter j\u00e1 ativado, considerando que deveria reagir rapidamente a viola\u00e7\u00f5es por parte dos Estados-membros. Como um dos principais pa\u00edses europeus que est\u00e3o a receber refugiados, a Pol\u00f3nia \u00e9 um dos Estados-membros que se op\u00f5e mais frontalmente \u00e0 R\u00fassia. Como vizinha da Ucr\u00e2nia, a Hungria tamb\u00e9m est\u00e1 a ser fortemente afetada, embora Orb\u00e1n tenha refor\u00e7ado recentemente a depend\u00eancia energ\u00e9tica do pa\u00eds e as rela\u00e7\u00f5es com a R\u00fassia. Devido ao grande aumento nas d\u00edvidas\u00a0 e nos d\u00e9fices nacionais (respetivamente, 92,1% e 6,6%, segundo a Comiss\u00e3o Europeia), foi considerado conveniente suspender o procedimento destinado a assegurar que o d\u00e9fice e a d\u00edvida dos Estados-membros nunca ultrapassem, respetivamente, 3% e 60% do PIB.<\/p>\n Embora a Comiss\u00e3o defenda manter a cl\u00e1usula ativa at\u00e9 2023, o plano \u00e9 chegar a um acordo de estabilidade mais amplo sobre os novos regulamentos fiscais para o contexto p\u00f3s-pand\u00e9mico.<\/p>\n Desde o in\u00edcio do debate em torno da reforma dos regulamentos fiscais<\/strong>, duas posi\u00e7\u00f5es principais tornaram-se vis\u00edveis: por um lado, pa\u00edses como Espanha, It\u00e1lia e Fran\u00e7a defendem um quadro mais flex\u00edvel; por outro, os Estados-membros conhecidos como os Quatro Frugais (\u00c1ustria, Pa\u00edses Baixos, Su\u00e9cia e Dinamarca), que preferem a disciplina fiscal. Para contribuir para este debate, Espanha prop\u00f4s a elimina\u00e7\u00e3o dos investimentos verdes e digitais do sistema fiscal deficit\u00e1rio p\u00fablico.<\/p>\n No entanto, mudan\u00e7as governamentais tanto na Alemanha como nos Pa\u00edses Baixos no final de 2021, pa\u00edses que tradicionalmente representavam uma posi\u00e7\u00e3o fiscal mais estrita, criaram um cen\u00e1rio que eventualmente pode ser positivo para a flexibiliza\u00e7\u00e3o dos regulamentos fiscais. No caso da Alemanha, o acordo governamental est\u00e1 interessado em apresentar uma posi\u00e7\u00e3o aberta e construtiva nas negocia\u00e7\u00f5es, um desenvolvimento digno de nota dada a posi\u00e7\u00e3o tradicionalmente ortodoxa de Christian Lindner, ministro das Finan\u00e7as alem\u00e3o. Do mesmo modo, o acordo do governo holand\u00eas assinado em dezembro de 2021 inclui muitos compromissos de despesa p\u00fablica, o que dificultar\u00e1 o cumprimento dos limites m\u00e1ximos por parte do pa\u00eds originalmente estabelecidos no Pacto de Estabilidade.<\/p>\n Tal como acontece com o resto dos debates pol\u00edticos, a crise na Ucr\u00e2nia <\/strong>tamb\u00e9m teve impacto na quest\u00e3o fiscal. Neste sentido, a Comiss\u00e3o reconhece que a atual incerteza pode exigir uma posi\u00e7\u00e3o mais aberta e flex\u00edvel. Al\u00e9m disso, poder\u00e1 haver a possibilidade de prorrogar a cl\u00e1usula geral de fuga durante 2023, o ano em que dever\u00e1 ser desativada. Teremos de esperar at\u00e9 \u00e0 previs\u00e3o econ\u00f3mica da Primavera para ver se \u00e9 tomada uma decis\u00e3o a este respeito.<\/p>\n Esta discuss\u00e3o fiscal mais ampla delineia a discuss\u00e3o mais espec\u00edfica sobre a natureza permanente do Instrumento para a Recupera\u00e7\u00e3o da Europa<\/strong>. Espanha est\u00e1 entre os Estados-membros que t\u00eam defendido esta possibilidade. O novo acordo do governo alem\u00e3o sublinha o facto de que se trata de um instrumento limitado no tempo, embora estejam abertos \u00e0 cria\u00e7\u00e3o de outros instrumentos no futuro. de Trabalho para 2022<\/strong>, que indica as principais iniciativas legislativas que visam promover durante o ano. Estas iniciativas baseiam-se nas orienta\u00e7\u00f5es pol\u00edticas que a Presidente Von der Leyen tornou p\u00fablicas no in\u00edcio do seu mandato e estabelecem os objetivos que ela pretende alcan\u00e7ar durante o atual ciclo pol\u00edtico (2019-2024). Apesar da fun\u00e7\u00e3o legislativa da UE caber ao Conselho e ao Parlamento Europeu, \u00e9 a Comiss\u00e3o Europeia que tem de apresentar as iniciativas, pelo que os atos legislativos s\u00f3 poder\u00e3o ser adotados depois de terem sido propostos pela Comiss\u00e3o.<\/p>\n De acordo com os dados mais recentes da Comiss\u00e3o, no final de agosto de 2021, tinham sido apresentadas 52% das iniciativas em torno das seis principais prioridades pol\u00edticas, e 48% delas tinham sido adotadas como atos legislativos tanto pelo Parlamento Europeu como pelo Conselho.<\/p>\n O Plano de Trabalho da Comiss\u00e3o para o ano \u00e9 especialmente importante, pois marca a metade do mandato, que terminar\u00e1 em 2024. mais significativas <\/strong>previstas nas orienta\u00e7\u00f5es pol\u00edticas da Comiss\u00e3o. Contudo, das 90 propostas totais, a Comiss\u00e3o apresentou apenas um ter\u00e7o (28), das quais apenas 15 foram adotadas pelos co-legisladores (o Conselho e o Parlamento Europeu).<\/p>\n Mais especificamente, o que mais se destaca \u00e9 o pacote de medidas legislativas apresentado pela Comiss\u00e3o, em junho de 2021, conhecido como Fit For 55<\/strong>. O objetivo destas medidas \u00e9 reduzir 55% das emiss\u00f5es com efeito de estufa at\u00e9 2030. Estas propostas seguem a Lei Europeia do Clima e consideram uma vasta gama de medidas que afetam, entre outras, a energia, o clima e os transportes.<\/p>\n Entre elas, real\u00e7amos o esbo\u00e7o de Regulamento para criar o Mecanismo de Ajuste Fronteiri\u00e7o de Carbono<\/strong> (CBAM – Carbon Border Adjustment Mechanism). A longo prazo, este sistema substituir\u00e1 a Diretiva 2003\/87\/CE para o estabelecimento de um regime de com\u00e9rcio de licen\u00e7as de emiss\u00e3o de gases com efeito de estufa. O seu objetivo \u00e9 fixar o pre\u00e7o do carbono, evitando os riscos de relocaliza\u00e7\u00e3o da ind\u00fastria para outras regi\u00f5es n\u00e3o partilhando as normas clim\u00e1ticas da Uni\u00e3o. Embora a ado\u00e7\u00e3o deste Regulamento se encontre numa fase muito precoce, na verdade, \u00e9 uma das prioridades da presid\u00eancia francesa, e o Conselho j\u00e1 adotou a sua posi\u00e7\u00e3o sobre a proposta da Comiss\u00e3o. No entanto, antes do in\u00edcio das negocia\u00e7\u00f5es com o Conselho e o Parlamento Europeu, o Parlamento tem de concordar com a sua posi\u00e7\u00e3o.<\/p>\n Para al\u00e9m disso, o programa da Energias Renov\u00e1veis<\/strong>.<\/p>\n Al\u00e9m disso, no quadro do plano de a\u00e7\u00e3o \u201cpolui\u00e7\u00e3o zero<\/em>\u201d, a Comiss\u00e3o avan\u00e7ar\u00e1 uma gest\u00e3o integrada da \u00e1gua<\/strong> para lidar com contaminantes superficiais e subterr\u00e2neos da \u00e1gua. Do mesmo modo, os regulamentos da UE sobre a qualidade do ar<\/strong> ser\u00e3o revistos para os adaptar \u00e0s recomenda\u00e7\u00f5es da Organiza\u00e7\u00e3o Mundial da Sa\u00fade.<\/p>\n Relativamente \u00e0 mobilidade sustent\u00e1vel<\/strong>, a Comiss\u00e3o apresentou algumas medidas incluindo o esbo\u00e7o de regulamento sobre a utiliza\u00e7\u00e3o de combust\u00edveis renov\u00e1veis e com baixo teor de carbono no transporte mar\u00edtimo, o esbo\u00e7o de Regulamento sobre a garantia de condi\u00e7\u00f5es equitativas para o transporte a\u00e9reo sustent\u00e1vel, e a reforma da iniciativa do C\u00e9u \u00danico Europeu. Esta medida centra-se na rotulagem, normaliza\u00e7\u00e3o, certifica\u00e7\u00e3o e regula\u00e7\u00e3o da liberta\u00e7\u00e3o n\u00e3o intencional de micropl\u00e1sticos; o desenvolvimento e a harmoniza\u00e7\u00e3o dos m\u00e9todos de medi\u00e7\u00e3o da liberta\u00e7\u00e3o n\u00e3o intencional de micropl\u00e1sticos, a redu\u00e7\u00e3o da viola\u00e7\u00e3o do conhecimento cient\u00edfico sobre o risco e a presen\u00e7a de micropl\u00e1sticos no meio ambiente, na \u00e1gua pot\u00e1vel e nos alimentos. Espera-se que a Comiss\u00e3o adote uma proposta durante o \u00faltimo trimestre de 2022. No final de 2022, a Comiss\u00e3o ter\u00e1 adotado um quadro estrat\u00e9gico para biopl\u00e1sticos<\/strong> e pl\u00e1sticos biodegrad\u00e1veis e compost\u00e1veis<\/strong>.<\/p>\n Relativamente \u00e0 economia circular<\/strong>, no terceiro trimestre de 2022, ser\u00e1 apresentada uma iniciativa sobre o direito dos consumidores a compensa\u00e7\u00f5es de pre\u00e7os justos<\/strong>. Do mesmo modo, a revis\u00e3o da Diretiva relativa a embalagens e res\u00edduos de embalagens<\/strong> em que a Comiss\u00e3o est\u00e1 a trabalhar tem por objetivo harmonizar o livre fluxo de embalagens e direitos sobre mercadorias embaladas. O principal objetivo \u00e9 reduzir a cria\u00e7\u00e3o de res\u00edduos de embalagens, limitar certos materiais de embalagem e reduzir a complexidade dos materiais de embalagem. Os objetivos da Comiss\u00e3o s\u00e3o compensar fabricantes, que sofrer\u00e3o um aumento nos seus custos de produ\u00e7\u00e3o atrav\u00e9s da redu\u00e7\u00e3o dos impostos alargados de responsabilidade do produtor.<\/p>\n O rascunho de Regulamento sobre expedi\u00e7\u00f5es de res\u00edduos<\/strong> visa impedir a UE de exportar as suas obriga\u00e7\u00f5es em mat\u00e9ria de res\u00edduos para pa\u00edses terceiros. As empresas exportadoras da UE ser\u00e3o sujeitas a auditorias independentes, e a Comiss\u00e3o ter\u00e1 o direito de suspender a expedi\u00e7\u00e3o de res\u00edduos para certos pa\u00edses. A expedi\u00e7\u00e3o de res\u00edduos para fins de reciclagem ser\u00e1 mais acess\u00edvel atrav\u00e9s da digitaliza\u00e7\u00e3o das expedi\u00e7\u00f5es, da cria\u00e7\u00e3o de crit\u00e9rios de classifica\u00e7\u00e3o harmonizados na UE e de condi\u00e7\u00f5es mais rigorosas para a expedi\u00e7\u00e3o de res\u00edduos para crema\u00e7\u00e3o<\/strong>. O rascunho ainda se encontra nas fases iniciais do processo legislativo, pelo que a sua aprova\u00e7\u00e3o n\u00e3o est\u00e1 prevista at\u00e9, pelo menos, ao in\u00edcio de 2023.<\/p>\n Relativamente \u00e0 alimenta\u00e7\u00e3o e agricultura<\/strong>, durante o segundo trimestre de 2022, espera-se uma iniciativa legislativa para rever a regulamenta\u00e7\u00e3o relativa \u00e0 classifica\u00e7\u00e3o, \u00e0 rotulagem e ao embalamento <\/strong>para proteger melhor a sa\u00fade humana e o meio ambiente. Para este ano, est\u00e1 tamb\u00e9m previsto rever as regras para o uso sustent\u00e1vel de pesticidas<\/strong> e um rascunho de Resolu\u00e7\u00e3o sobre produtos sem desfloresta\u00e7\u00e3o<\/strong>. Esta \u00faltima garantir\u00e1 que apenas produtos sem desfloresta\u00e7\u00e3o entrem no mercado da UE, for\u00e7ando os agentes econ\u00f3micos que exportam produtos para a UE a informarem sobre a localiza\u00e7\u00e3o geogr\u00e1fica da terra em que os bens foram produzidos.<\/p>\n Na \u00e1rea da agricultura, resta saber se a crise na Ucr\u00e2nia<\/strong> tem consequ\u00eancias nos planos europeus de avan\u00e7ar para uma agricultura mais sustent\u00e1vel e, mais especificamente, na Estrat\u00e9gia Farm to Fork<\/strong> (do prado ao prato). foram apresentadas e que est\u00e3o pendentes de ado\u00e7\u00e3o, destaca-se o rascunho de Regulamento sobre a Lei dos Servi\u00e7os Digitais (DSA)<\/strong> que visa a prote\u00e7\u00e3o dos direitos dos utilizadores online. O Conselho e o Parlamento chegaram recentemente a um acordo pol\u00edtico provis\u00f3rio sobre a Lei dos Mercados Digitais (DMA)<\/strong> que visa garantir que nenhuma grande plataforma online que atue como \u201cguardi\u00e3\u201d para um grande n\u00famero de utilizadores abuse da sua posi\u00e7\u00e3o em detrimento das empresas que querem ter acesso a esses utilizadores. O regulamento deve ser implementado no prazo de seis meses ap\u00f3s a sua entrada em vigor. A presid\u00eancia francesa do Conselho da UE tinha declarado ambas as propostas como priorit\u00e1rias.<\/p>\n Outra iniciativa pendente \u00e9 o rascunho de Regulamento sobre Intelig\u00eancia Artificial.<\/strong> No entanto, o trabalho a este respeito foi atrasado, pois os co-legisladores ainda n\u00e3o chegaram a acordo sobre as suas posi\u00e7\u00f5es. O rascunho de Regulamento para implementar a identidade digital<\/strong> na Uni\u00e3o Europeia est\u00e1 previsto avan\u00e7ar em 2022 tamb\u00e9m.<\/p>\n Algumas a\u00e7\u00f5es n\u00e3o-legislativas propostas em quadros estrat\u00e9gicos para orientar o projeto de digitaliza\u00e7\u00e3o da UE, tais como o Plano de A\u00e7\u00e3o para a Educa\u00e7\u00e3o Digital<\/strong> (2021-2027) e o Path to Digital Decade<\/strong> para alcan\u00e7ar a transforma\u00e7\u00e3o digital at\u00e9 2030, devem ser igualmente mencionadas.<\/p>\n Para al\u00e9m do que j\u00e1 est\u00e1 em curso, a Comiss\u00e3o apresentar\u00e1 novas iniciativas durante 2022 em \u00e1reas tais como servi\u00e7os digitais para a mobilidade multimodal<\/strong>. A este respeito, as propostas mais esperadas da Comiss\u00e3o e sublinhadas pela Presidente Von der Leyen no seu \u00faltimo discurso sobre o Estado da Uni\u00e3o s\u00e3o o European Chips Act<\/strong> que promover\u00e1 um ecossistema europeu para chips; e o Cyber Resilience Act europeu.<\/strong> Espera-se que a primeira lei seja apresentada durante o segundo trimestre de 2022, enquanto a segunda \u00e9 mais prov\u00e1vel que surja no terceiro trimestre.<\/p>\n O setor energ\u00e9tico ser\u00e1 tamb\u00e9m fundamental, uma vez que a Comiss\u00e3o est\u00e1 a planear propor Assim, foi aqui que se registaram mais progressos. Segundo a Comiss\u00e3o, a explica\u00e7\u00e3o para isto \u00e9 a necessidade de recuperar rapidamente do impacto da pandemia.<\/p>\n Uma das iniciativas mais importantes, que \u00e9 tamb\u00e9m uma das prioridades da atual presid\u00eancia francesa do Conselho, est\u00e1 relacionada com tributa\u00e7\u00e3o.<\/strong> Em outubro de 2021, os Estados-membros da OCDE chegaram a um acordo sobre a reforma do sistema fiscal. O acordo \u00e9 composto por dois pilares: Pilar I) reafeta\u00e7\u00e3o de direitos fiscais sobre as jurisdi\u00e7\u00f5es em que as empresas multinacionais operam; e Pilar II) introdu\u00e7\u00e3o de uma taxa m\u00ednima de imposto de, pelo menos, 15% para os lucros das empresas.<\/strong><\/p>\n Relativamente ao segundo pilar, no final de 2021, a Comiss\u00e3o apresentou uma Diretiva de transposi\u00e7\u00e3o do acordo<\/strong> ao n\u00edvel europeu, estando a sua implementa\u00e7\u00e3o prevista para 2023. Atualmente, o Conselho e o Parlamento Europeu est\u00e3o a estudar esta proposta. Muitos Estados-membros ainda est\u00e3o relutantes quanto ao que se est\u00e1 a debater. Contudo, este dossi\u00ea \u00e9 uma prioridade para a presid\u00eancia francesa, esperando que se chegue a um acordo no Conselho, em abril. Em rela\u00e7\u00e3o ao primeiro pilar, espera-se que a Comiss\u00e3o apresente uma proposta durante o ano.<\/p>\n Estas iniciativas est\u00e3o enquadradas numa reforma mais profunda e mais ampla do sistema fiscal da UE. Isto inclui, por exemplo, a Comunica\u00e7\u00e3o apresentada pela Comiss\u00e3o em maio de 2021, intitulada Business Europe Framework Income Taxation (BEFIT).<\/strong> Esta iniciativa visa estabelecer regras comuns para o c\u00e1lculo da base de c\u00e1lculo do imposto sobre as sociedades, fomentando uma distribui\u00e7\u00e3o mais justa dos direitos fiscais entre os Estados-membros. Do mesmo modo, em 2023, a Diretiva que obriga as grandes empresas multinacionais a tornar p\u00fablicos os impostos que pagam em cada Estado-membro<\/strong> entrar\u00e3o em vigor e produzir\u00e3o Europa.<\/p>\n Relativamente ao direito do trabalho, em dezembro de 2021, a Comiss\u00e3o prop\u00f4s uma Diretiva para melhorar as condi\u00e7\u00f5es de trabalho das pessoas que trabalham atrav\u00e9s de plataformas de trabalho digitais<\/strong>. Esta lei encontra-se numa fase muito precoce do processo legislativo, que dever\u00e1 continuar durante 2022. Uma das restantes iniciativas pendentes \u00e9 a proposta de uma Diretiva sobre sal\u00e1rios m\u00ednimos adequados<\/strong>, que iniciou recentemente a sua fase de negocia\u00e7\u00e3o entre os A este respeito, no \u00faltimo discurso no Estado da Uni\u00e3o, a Presidente Von der Leyen sublinhou a necessidade de refor\u00e7ar o papel da UE no mundo.<\/p>\n Na sequ\u00eancia deste quadro, a Comiss\u00e3o apresentou a iniciativa Global Gateway <\/strong>que visa mobilizar at\u00e9 300 mil milh\u00f5es de euros para investimentos em ind\u00fastrias estrat\u00e9gicas em todo o mundo. O objetivo \u00e9 competir com a iniciativa chinesa One Road One Belt e contrariar a influ\u00eancia da China em regi\u00f5es como \u00c1frica.<\/p>\n Do mesmo modo, Von der Leyen sublinhou a import\u00e2ncia de continuar a desenvolver a Uni\u00e3o Europeia da Defesa<\/strong>. A este respeito, em 2021, a Comiss\u00e3o lan\u00e7ou o Fundo Europeu de Defesa, <\/strong>cujo objetivo \u00e9 apoiar projetos de investiga\u00e7\u00e3o e desenvolvimento na ind\u00fastria da defesa. A invas\u00e3o russa da Ucr\u00e2nia<\/strong> h\u00e1 apenas um m\u00eas ou a cimeira UE-China<\/strong>, que tentar\u00e1 reduzir as tens\u00f5es crescentes entre as duas, no in\u00edcio de abril s\u00e3o suficientemente ilustrativas da nova ordem global a que a Uni\u00e3o se deve habituar. \u00c9 dentro deste novo cen\u00e1rio que a Comiss\u00e3o von der Leyen pretende jogar mais geopoliticamente.<\/p>\n O Plano de Trabalho original da Comiss\u00e3o Europeia de 2022, que inclui as novas iniciativas que pretende iniciar juntamente com as quest\u00f5es pendentes, \u00e9 extenso e enquadra-se num vasto leque de \u00e1reas tem\u00e1ticas. Tornar-se um campe\u00e3o contra as altera\u00e7\u00f5es clim\u00e1ticas e refor\u00e7ar a economia digital, com os respetivos pacotes regulamentares, continuam a ser dois dos objetivos mais importantes.
